One of the most talented pass-rushers in the NFL continues to have problems with all the stuff that isnít football.

According to Matt Maiocco of CSNBayArea.com, 49ers outside linebacker Aldon Smith was arrested at 7 a.m. this morning on suspicion of DUI, according to the San Jose Police.

Smith was reportedly identified as the driver in a single-car wreck, though no one was injured.

Thatís the good news. The bad news is Smith adds to a long list of off-field issues, which include being sued for an incident at his home that led to a shooting, as well as a previous DUI arrest in Miami Beach (the charges were reduced), being stabbed and being the passenger in a car which flipped trying to avoid a deer.

Thereís been no word from the 49ers at this point as to whether heíll play this week against the Colts, though that seems far down the list of priorities

This is his second one, saw a suspension is possible but wouldn't bet on it.

If it was indeed a DUI he should be done for the year, but I dont know the full story. I could see a 6 game suspension. Enough to make it look like the league cares, but not enough to damage revenue.

Since this was his second arrest since he came into the league, I think he should be suspended at least 4 games.

What is 'suspicion of DUI' ?

Is it suspicion of a substance that cannot be tested for?

Is it not about Alcohol?

Maybe they think he was on some kind of drugs

What is 'suspicion of DUI' ?

Is it suspicion of a substance that cannot be tested for?

Is it not about Alcohol?

Maybe they think he was on some kind of drugs

Refuse the road tests and opt for test at the station or hospital, they then take him in to custody to transport him to be tested.

If for instance they only find weed in his blood

They cannot prove that he was under the influence at the time he was driving because weed shows for up to a full month after usage. .......

Maybe we're just so early on the report that yes, they just haven't gotten their results yet.

So far if you are comparing Von and Smith

Smith has already outdone Von when it comes to immorality. -allegedly-

That is unless you consider Von's issues to be a slight on his responsibility to his team mates being disregarded - that is in a way immoral. But his issues in themselves are just trivial. Not making excuses for Von because its got to stop at some point.

I will remain consistent the same as I was when Von had his issues come out. I don't think issues like this should warrant suspensions unless the player has violated a policy of the NFL. If they have then they should be subject to the rules but I don't think they should be made an example of just for examples sake.

i have to say two wrongs don't make one right. on the same note, VM in my eyes just made a few stupid choices, nothing earth shattering. didn't pay tickets, driving w/o a lic., smokes a bit.

i will say it shouldn't be celebrated that smith got another DUI along with three explanation points. whats the difference to us? nothing. what does it prove? smith is in more bad shape then our guy. great, what do we win? know what i'm sayin?

Just heard from Clayton that Aldon is already in the drug program and may get a 1 game suspension. I'm confused. 2 DUI's and only 1 game??? Plus all his other stuff- stabbing, etc. This makes no sense when Von gets 6.

Smith can kill someone driving drugged, but Von can't hurt anyone smoking marihuana

Its absurd. A guy smokes some weed and dilutes a test and he gets 6 games. A guy gets 2 dui's and maybe gets a 1 game suspension?

I'm really upset about this because I keep hearing he will only receive a minimal suspension. 2 DUI, a stabbing in which he is being sued, and he is already in the drug program.

The other thing I'm kind of pissed about.... When Von got in trouble, the Breaking News was BOLDED and scrolled across the bottom in RED and on the top of the screen for everyone to notice but this is kind of hidden within regular news report. Go figure.

Well, if smoking a little bit of weed amounts to a 6 game suspension, I would assume that smoking weed, firing off illegal firearms in a crowd of people and 2 DUI's has got to be worth at least 3 seasons worth of suspensions. One crime puts nobody in danger and is actually not a crime in Colorado at all. The other puts the lives of many in jeopardy. The Von suspension was overkill, period, and they did it to make an example out of him. Time for the league to put their money with their mouths are. If you are going to treat all the players equally, Aldon Smith has a suspension of biblical proportions coming his way.

Unfortunately Von got gonged severely because of nfl policy which dictates the punishment. Fail one test....miss another.... It's a process that is fixed. Personal conduct is up to the commish. Fist time suspension will prob be a couple of games.

This is his second DUI, also had a shooting possibly and other things.

Anywhere from 4-8 games is fair if he gets any at all.

Smith has not yet been punished by the NFL for his past transgressions, but a second DUI may put him in line to be hit with a suspension. Such punishment might not occur until the start of the 2014 season, though the 49ers also could choose to step in and deliver a penalty of their own.

Maybe next year they will suspend him :rolleyes:

Apparently he is checking himself into rehab. Hopefully it works out for him, too talented to throw away a career like his.
