  • I Missed JURY DUTY!!!

    NNNNNNNNNNNNNOOOOOOOOOOOOOOOOOOOOO!!!!!

I don't know how this works here in Colorado. Can anybody fill me in. I can honestly say that I was never selected to go to Jury Duty until about a month ago. I received the summon in the mail for last Monday, and I completely forgot.

What are the consequences? Please help. I'm kinda freaking out.

Call me crazy, but I'd rather spend one night in jail than pay a freakin fine. I hope it isn't a big deal like you say.

Should I expect a fine? Should I sound sorry when I call? I just don't want to draw attention to myself so they can slap me with a big ass fine.

yeah, i'm pretty sure you just have to call them and let them know what happened... i think at most you get rescheduled, and who knows maybe you wouldn't have even been selected for any juries

Definitley call. I dont know any specifics, but, a quick google search yielded this

Any person summoned for jury service who fails to respond or appear may be ordered by the Court to appear at their own expense to show good cause for their failure to comply with a summons. Any person failing to show good cause for non-compliance with the jury summons may be fined not more than $100 or imprisoned for not more than three days, or both, pursuant to Title 28,United State Code, Section 1866.

FAILURE TO RESPOND: Jury Duty is a civic duty of each citizen. Failure to respond to the jury summons may result in CONTEMPT OF COURT.

                That's state.

CONTEMPT OF COURT - Any willful disobedience to, or disregard of, a court order or any misconduct in the presence of a court; action that interferes with a judge's ability to administer justice or that insults the dignity of the court; punishable by fine or imprisonment or both. There are both civil and criminal contempts; the distinction is often unclear.

Contempt Of Court -- Civil Or Criminal

A judge who feels someone is improperly challenging or ignoring the court's authority has the power to declare the defiant person (called the contemnor) in contempt of court. There are two types of contempt - criminal and civil. Criminal contempt occurs when the contemnor actually interferes with the ability of the court to function properly - for example, by yelling at the judge. This is also called direct contempt because it occurs directly in front of the judge. A criminal contemnor may be fined, jailed or both as punishment for his act.

Civil contempt occurs when the contemnor willfully disobeys a court order. This is also called indirect contempt because it occurs outside the judge's immediate realm and evidence must be presented to the judge to prove the contempt. A civil contemnor, too, may be fined, jailed or both. The fine or jailing is meant to coerce the contemnor into obeying the court, not to punish him, and the contemnor will be released from jail just as soon as he complies with the court order. In family law, civil contempt is one way a court enforces alimony, child support, custody and visitation orders which have been violated.

Being summoned for jury duty is a big deal. It' the reason why we call this society a democracy.

                  Shame on you for forgetting.

Depending on whether this was a civil or criminal trial, will depend on your punishment for not showing up.

To everyone that reads this, you should not simply "forget" about it.

If for some reason you cannot attend, you call before hand and will be excused.

I was called in Colorado years ago for a civil case. I just so happened to be the first number on the list and ended up being foreman of this jury.

If you were not in the top 10-20 numbers, chances are you were not missed.

BUT... you need to call immediately and explain or admit your absense. You should also expect to be called upon again in the near future.

Not to take it off topic...

I guess I've never really knew jury duty was handled differently. Here in town for jury cases you get called into a jury pool which is about 20 or so people. The jury waiting area has seating for over 200 people easily. The jury pool is selected randomly and from that random selection the lawyers make their selections. For the cases you may never know what you'll run into. The one case I was selected for was a civil case which we had only 4 jurors and it was a one day deal.

From what I've read here, it seems your already assigned a case for which you may be a juror on?

I've know a couple who missed here and they were just assigned to another day and told not to miss.

The only other time I was selected I called for the exact time and day to report and was told not to bother.

Are you sure it even made it that far?

Most cases are settled before it even gets to the point of the jury selection. There should be a number or a website on your summons where you can see if it was cancelled. If so, off the hook. If not, definately call, apologize, and take your medicine!
