Here is a site that seems to have the skinny on the McD's case, in case anyone wants to know what really happened, and why McDonald's was really sued. Also, the temperatures are just absurd - far more than I previously recalled.

Also, the monetary damages are far less than I seem to have heard before.

Just in case anyone was interested.

Here's another site to go along with the first.

Both sites are brief. Might be worth the time to learn about. Here's a snippet:

After careful deliberation, the jury found McDonald's was liable because the facts were overwhelmingly against the company. When it came to the punitive damages, the jury found that McDonald's had engaged in willful, reckless, malicious, or wanton conduct, and rendered a punitive damage award of 2.7 million dollars. (The equivalent of just two days of coffee sales, McDonalds Corporation generates revenues in excess of 1.3 million dollars daily from the sale of its coffee, selling 1 billion cups each year.)

On appeal, a judge lowered the award to $480,000, a fact not widely publicized in the media.

Two teenage girls who surprised their neighbors with homemade cookies late one night were ordered to pay nearly $900 in medical bills for a woman who says she was so startled that she had to go to the hospital. Judge Doug Walker declined Thursday to award punitive damages, saying he did not believe the girls acted maliciously.
So she sued for more, but only got the doctor bill of 900 paid.

        hey

I used to do that stuff when I was a young'un!

My buddy Dan and I, we would carefully sneak up onto a neighbors porch, particularly a neighbor lady like the one in this story, and then we would leave our "TREAT", and ring the bell.

As the kindly old GREEDSTER would answer the bell, she would open the door to find a flaming paper bag! AS she would stomp on it to extinguish the flames, she would find our treat inside. It was full of Doggy Do!

We never targeted some one who did not deserve it. Deserve it,any way, in the estimation of 2 savvy teenagers. Were it not such a long drive to Durango, I might be tempted to relive my youth!

Thanks alastor - I was gonna jump all over that one - I have to tell people the McD's story at least once a day - it goes to show you how people misconstrue things before finding out the FACTS - you cant base your opinion on legal matters by reading anything in the media - if you are not in the courtroom at the time of the trial or hearing - dont pass judgement because you dont have all the information to make a proper one -

Same in this case - from the outside this looks absolutely absurd - if there are no other mitigating circumstances this judge, if elected, will probably not get re-elected - I cant imagine this ending here if these are all the facts - I can tell you that I would fight this all the way to the Supreme Court if it was my daughter -

Well, nobody else seemed to notice this post but I just wanted to say thanks for the enlightenment.

I'm not too big to admit that I was one of the misinformed people who thought that lady was just trying to "get rich quick" with another frivolous lawsuit. I was wrong. It looks as though Mickey Dee's was in need of a good slap on the wrist (since that's all it was) to maybe at least make them rethink their coffee temperature philosophy.

I don't like finding out I am wrong about something (especially since I've made disparaging comments about that lady in the past). But I like it even less when I'm wrong about something and never know it. The gaining of knowledge is the path to enlightenment (variation on that quote).

Anyway, I still believe there are way too many "get rich quick" lawsuits out there. It just turns out that the McDonald's lady wasn't one of them.

Well, just I as stated that nobody else noticed that post, somebody else noticed it. There you go again with your feminine psychological ploys to demean men.

Oh, yeah! I forgot about that. Man, I'd best be more careful or I'll be getting my MCP license revoked.

The Denver Post newspaper reported on Friday that the girls had decided to stay home and bake the cookies rather than go to a dance where there might be cursing and drinking.
That could be the single funniest sentence I've ever read.

                          ****, *****, gulp gulp, ****!

When I read the heading I thought maybe the girls had poisoned the cookies, or laced them with pcp or something. How paranoid do you have to be to have a heart attack over your doorbell ringing and cookies being left on the welcome mat? Old bag, she could use some pcp.

Well, keep in mind there could be something we don't know about here... the woman could be agoraphobic and the girls might have actually scared the crap out of her.

My mom's neighbor who recently passed on was a sweetheart of a lady, but she was pretty agoraphobic herself, and even I couldn't ever get her to come to the door and II was over there... often.

                            ::shrug::

There *could* be reasons behind it that they just aren't sharing. I'd like to see the judge's opinion on the case and see why he found the way he did. I might go try to dig that up actually...

I would think that he would want his side heard as to avoid career suicide. If we don't hear about it now, I'm sure we will come election time!
